Heard Shri R. Menezes, learned Advocate for the applicant and Shri M. Amonkar, learned Additional Public Prosecutor for the Respondent.

This is an application for bail at the instance of the applicant who has been arrayed as an accused for the alleged commission of the offences punishable under Section 370, 370A IPC apart from Sections 4,5 & 7 of the Immoral Traffic (Prevention) Act, 1956 against whom a chargesheet has been filed before the learned JMFC at Mapusa.

On hearing Shri R. Menezes, learned Advocate for the applicant and Shri M. Amonkar, learned Additional Public Prosecutor for the respondent and considering the fact that the investigation in the matter is complete and chargesheet too has been filed, the applicant can be secured with an order of bail.

Shri M. Amonkar, learned Additional Public Prosecutor for the respondent submits that stringent conditions be imposed for the release of the applicant on bail looking to the nature, gravity and seriousness of the offences involved and more particularly that the applicant is not a permanent resident of the State.

Having heard the learned advocate for the applicant and the learned Additional Public Prosecutor for the respondent, i am inclined to grant the bail to the applicant on the following conditions:
(i) The applicant shall be released on bail on executing a bail bond in the sum of ₹50,000/- with two sureties one of whom shall be a local surety in the like amount to the satisfaction of the learned Trial
Court, Mapusa.
(ii) He shall furnish his local address and the particulars of his mobile number, if any, to the Investigating Officer within three days from the date of his release.
(iii) He shall not tamper with the witnesses and other evidence involved in the said offence against him.
(iv) In the event it is found that he is involved in such or similar offences, the State shall be at liberty to seek the cancellation of his bail.
(v) In these terms, the application stands disposed off.
