The applicant/accused was tried and is convicted for the offences punishable under Sections 279, 337 and 304-A of I.P.C. by the learned Judicial Magistrate First Class, Vasco on 27.5.2014 against which the applicant has preferred an Criminal Appeal which was dismissed by the Additional Sessions Judge, South Goa, Margao.

2. Heard Mr. A. Gaonkar, learned counsel appearing for the applicant and Mr. M. Amonkar, learned Additional Public Prosecutor appearing for the respondents.

3. During the course of arguments learned Advocate appearing for the applicant has stated that during the pendency of the criminal case as well as the appeal before the District Judge, the applicant/accused was on bail and has not misused the bail and has presented the appeal against the said impugned order and therefore prayed for his release

CRMA/129/2015 on bail till the disposal of the appeal.

4. Hence, I pass the following:- (i) The applicant be released on bail on furnishing personal bond of Rs. 25,000/-with surety in the like amount to the satisfaction of the Registrar(Judicial) of this Court.

(ii) Substantive sentence imposed upon the applicant is suspended upon deposit of fine amount before the Registry(Judicial) of this Court.
