Heard Shri Naik, learned Counsel appearing for the Petitioner and Shri Kantak, learned Senior Counsel appearing for the Respondent no. 2.
2. After hearing the matter for sometime, Shri Arjun Naik, learned Counsel appearing for the Petitioner, upon instructions, seeks leave to withdraw the above Writ Petition with liberty to file Written arguments along with relevant public/official records or Orders passed by the judicial or quasi judicial authorities in support of his stand.
3. Shri S. S. Kantak, learned Senior Counsel appearing for the Respondent no. 2, points out that in case any such written arguments
WP/375/2015 and documents are produced, liberty may be given to the Respondent no. 2 to file submissions in reply.
4. The learned Mamlatdar shall consider such documents and material produced by the parties in accordance with law. Subject to said liberty to the Petitioner and the Respondent no. 2, the Petition stands dismissed as withdrawn. Needless to say, that in case the Petitioner, if so advised in law, may avail of any independent remedies, this Order shall not come in the way of the Petitioner. F. M. REIS, J.
