Adv. Mr. E. Afonso is present on behalf of the Appellant, Ms. Sonam Nayak is present on behalf of the respondent and Ms. R. Kantak is present on behalf of the Respondent no.5.

Both the parties have agreed for the following settlement:

1. Appellant will withdraw the appeal and respondent nos. 1 to 3 will withdraw the Crossobjections.

2. The amount deposited by the Appellant in which sum of Rs. 32,42,362/- minus the amount of Rs.10 lakhs which was already

withdrawn, shall be paid to the respondent nos.1 to 3 with accrued interest on the investment made by the registry. First Appeal alongwith XOB are disposed off.
