Mr. D. Lawande, learned Government Advocate appearing for the respondents No.6, 7 and 8 states that the complaint filed by the petitioners before the local Panchayat in connection with an alleged illegal construction in the property bearing Survey No. 69/12 of Village Pilerne has not yet been finally disposed of. The learned Government Advocate, upon instructions of the respondent No.7, states that the respondent No.7 shall issue notice to assume powers under Section 66(5) of the Goa Panchayat Raj Act in connection with the subject complaint and take necessary decision, in accordance with law, within a period of three months from today.
2. Considering that the concerned Authorities are intending to
WP/502/2016 take action in accordance with law, nothing survives in the present petition, at this stage.
3. The above petition stands, accordingly, disposed of by accepting the statement of the learned Government Advocate appearing for the respondents No.6, 7 and 8. Needless to say that all the contentions of both the parties are left open, as we have not gone into the correctness or otherwise of the allegations in the petition. NUTAN D. SARDESSAI, J.
