Respondents Mr. R. K. Tomar, Advocate for the Applicants/Appellants. Coram:- M. S. SONAK & SMT. M. S. JAWALKAR, JJ.
Date:- 11th December, 2019 P.C.
Heard Mr. Tomar, learned counsel for the Applicants/Appellants.
2.
Mr. Tomar points out that the service has been effected upon the Respondents and even the Advocate for the Respondents has been intimated about mentioning of these Civil Applications. 3.
Mr. Tomar, on the basis of the instructions from the Applicants/Appellants seeks leave to withdraw these appeals in order to pursue these matters before the designated committee constituted under Sabka Vishwas (Legacy Dispute Resolution) Scheme 2019 ( said Scheme). He points out that one of the pre-conditions for availing of the said Scheme
3 STA4138-19&Orsdt.11.12.2019 is to withdraw the pending matters. He however seeks leave to institute fresh proceedings, in case, the Applicants/Appellants failed to secure the relief before the designated committee under the said Scheme. According to us, the request made by and on behalf of the Applicants/Appellants is quite reasonable and legitimate. Accordingly, we allow the Applicants/Appellants to withdraw these appeals with liberty to take out such proceedings as may be available in terms of law, in case the Applicants/Appellants failed to secure the relief before the designated committee under the aforesaid Scheme.
4.
These Civil Applications as well as the appeals themselves are disposed of in the aforesaid terms.
5.
All concerned to act on the basis of the authenticated copy of this order.
