Heard Mr. N. Vaze, the learned Counsel for the petitioner and Mr. D. Pangam, the learned Advocate General along with Ms. M. Correia, the learned Additional Government Advocate for the respondents.

The petitioner's grievance is restricted to the imposition of penalty vide communication dated 28.01.2021 (at page 23 of the paper book). Mr. Vaze submits that such penalty was imposed without compliance with principles of natural justice. He submits that the petitioner has made a representation against the 29th July 2021

6-WP-255-2021.DOC imposition of such penalty on 17.03.2021 (at page 25 of the paper book) and directions may be issued for disposal of this representation, after afford of opportunity of hearing to the petitioner.

The learned Advocate General states that the representation dated 17.03.2021, made by the petitioner, will be disposed of in accordance with law and after granting an opportunity of hearing to the petitioner, as expeditiously as possible, and in any case within three months from today.

Mr. Vaze, the learned Counsel for the petitioner, states that the petitioner be granted liberty to make a fresh representation taking all permissible grounds and directions may be issued for consideration of the same. Learned Advocate General states that there can be no difficulty to the adoption of such a course of action.

Accordingly, liberty is granted to the petitioner to make a fresh representation within two weeks from today and the concerned respondents to dispose of the same within three months from the date of receipt of such fresh representation. 6.

With the aforesaid directions this petition is disposed of. There shall be no order as to costs.
