Heard Shri D. Gaonkar, learned Counsel for the petitioner, Shri R. Shiolkar, Additional Government Advocate for the respondents no.1 to 3 and Shri D. J. Pangam, learned Counsel for the respondent no.4.

2. Heard forthwith with the consent of the learned counsel for the parties.

3. A short grievance of the petitioner to be examined in the above petition is whether the decision taken by the respondent no.4 on the application for allotment of the plot pursuant to the Notification dated 24/04/2014 is reflected in the decision

WP/471/2017 communicated by the Administrator of Communidade to the petitioner by letter dated 03/11/2015 stands justified.

4. During the Course of hearing of the above petition Shri Pangam, learned Counsel for the respondent no.4 points out that the respondent no.4 shall take a fresh decision on the application filed by the petitioner for allotment uninfluenced with the impugned decision reflected in the communication dated 28/01/2016. Shri Pangam, learned Counsel for the respondent no.4 points out that the Notification dated 10/03/2016 shall be kept in abeyance with regard to the subject plot. Accepting the said statement of the learned Counsel for the respondent no.4 upon instructions of the Attorney who is present in the Court the above petition stands disposed off.

5. Needless to state that we have not gone into the merits of the contentions raised which are left open.
