None appears for the petitioners even on the second call.

2. Yesterday also, there was no appearance on behalf of the petitioners, when the matter was fixed today. That apart, it appears that the Trial Court had granted Temporary Injunction in favour of the respondent on 10/02/2010, restraining the petitioners from creating any third party interest in the suit property, pending disposal of the suit. The said order has been confirmed in appeal. It can, thus, be seen that the said order is operating from the year 2010.

3. The learned Counsel for the respondent, on instructions, states that trial in the suit, which is of the year 2007, has commenced.

4. In either case, as none appears for the petitioners, the petition is dismissed in default, with no order as to costs. C. V. BHADANG, J.
