The petitioner alleges that his bank account has been frozen by the respondent. There is nothing set out in the petition as to the circumstance in which such freezing order has been alleged to be made. There is no freezing order produced on record as well. The only averment in the petition is that a cheque issued by the petitioner has been returned dishonoured with an endorsement that the account has been frozen.
2. In a situation of the aforesaid nature, resort to the remedy under Articles 226 and 227 of the Constitution of India, would not be appropriate. The matter of this nature will undoubtedly, involve disputed questions of facts. Accordingly, this petition is not entertained. However, needless to add that the petitioner will
WP/482/2017 have the option to institute appropriate proceedings before the appropriate forum to seek redressal in the matter.
