Heard Shri Sagar Dhargalkar, learned Advocate for the applicant who contended that he had been making the deposit of the amount in the account of the respondent no.1 from March, 2015 onwards and till date he had deposited an amount of ₹2,19,000/- towards the cheque amount. The learned JMFC had sentenced him to undergo simple imprisonment for one year and to pay the compensation of ₹1,46,000/- with interest accrued thereon. It is apparent that the applicant has deposited an amount far in excess of that awarded by the learned JMFC as compensation.

In view thereof and without prejudice to the rights and

sta no.1612 of 2019 contentions of the respondent, the impugned judgment and sentence is stayed. The applicant is ordered to be enlarged on bail on executing a Bail Bond in the amount of ₹10,000/- and furnishing a local surety in the coextensive amount to the satisfaction of the learned JMFC, Ponda. In these terms, the application stands disposed off. Authenticated copy to be issued the parties.
