The learned Counsel for the petitioner seeks leave to delete respondent nos. 3 and 4.

2. Leave to delete respondent nos. 3 and 4, is granted at the risk of the petitioner. Amendment to be carried out forthwith.

3. By consent of the parties the petition is disposed of as under: (a) The impugned judgment and order dated 22.04.2016 passed by the learned President, Co-operative Tribunal in Miscellaneous Application No. 11/2016/Stay, is set aside.

(b) There shall be interim stay of the award dated 31.08.2015 passed by the learned Assistant Registrar in Case No.ARCS/SZ/SUCCS/ VAS/ABN-166/2002, subject to the condition of the petitioner depositing an amount of Rs.3,00,000/- (Rupees Three Lakhs) with

WP/517/2016 the Co-operative Tribunal, Panaji, within one week from today. (c) The deposit shall be subject to final outcome of the appeal. (d) In the event the petitioner fails to deposit the amount, the interim stay shall stand vacated automatically.

(e) In the event, the amount is deposited, the Co-operative Tribunal shall decide the appeal on its own merits, in accordance with law. C. V. BHADANG, J.
