An objection is raised by the learned Deputy Solicitor General of India that the criminal revision application is not maintainable. In the criminal revision application filed, miscellaneous application No.49 of 2023 has been moved for condoning the delay in filing the revision. Faced with the objection of the learned Deputy Solicitor General of India, the learned counsel for the applicant seeks leave to withdraw the revision application with leave to file appropriate proceedings 24th July, 2023

CRMA 49 of 2023 challenging the impugned order dated 01.08.2022.

2. Allowed to be withdrawn with liberty to challenge the order dated 01.08.2022 in appropriate proceedings. Needless to mention that the period spent in prosecuting the present revision may be sympathetically considered by the concerned Court when appropriate proceedings are filed challenging the order dated 01.08.2022.
