The Petitioner has filed an affidavit containing undertaking which is found in paragraph no. 8 and reads thus: "8. I say that I undertake to deposit in the Commercial Court at Vasco, Goa, the pending arrears which is Rs. 78,32,524/-(Rupees Seventy Eight Lakh Thirty Two Thousand Five Hundred and Twenty Four only) as calculated by the Respondent as per the Direction No 4 of Paragraph No. 92 of the Order dated 14.07.2023 within a period of 3 months from the date of Order passed by this Hon'ble Court."

The affidavit containing undertaking is taken on record and marked 'X' for identification 3.

In view of the above undertaking, the Petitioner is allowed to withdraw the present petition, however, liberty to deposit pending arrears as found mentioned in paragraph No. 8 of the affidavit cum undertaking within a period of three months, before the Commercial Court at Vasco, from today. 4.

The affidavit cum undertaking is accepted and is considered as undertaking given to this Court. 5.

The Petitioner shall deposit the arrears mentioned in paragraph No. 8 before the learned Commercial Court at Vasco within three months from today.

In view of the above undertaking, the petition stands disposed of as withdrawn.

The copy of this order should be forwarded to the learned Trial Court for reporting compliance. BHARAT P. DESHPANDE, J.
