Mr. Menezes, learned Counsel for the petitioner on instructions states that at this stage his client is not pressing the allegations made by the petitioner against the concerned officers of respondents, if respondent no.2 prepares papers/file of the petitioner for consideration of his case for premature release from jail in accordance with the provisions of Code of Criminal Procedure, the Goa Prison Rules and the Prison Manual for Superintendence of Prisons in Goa.

2. Mr. Phaldessai, learned Addl. Public Prosecutor for respondent nos.1 to 3 states that since the petitioner has not

WPCR/114/2019 pressed the allegations made against respondents, at this stage, respondent nos.1 to 3 would prepare such case file and would place the file before the State Review Board in the next meeting proposed to be held within a short span. Statement is accepted.

3. If any such file is prepared, State Review Board shall consider such file on its own merits. It is made clear that this Court has not expressed any views on merits of the matter. All contentions of both the parties are kept open.

4. Writ Petition is disposed of on the aforesaid terms with no order as to costs.
