The learned Counsel for the parties hand in Consent Terms which are taken on record and marked as 'X' for purpose of identification. The Consent Terms have been signed by Mr. Kunal Kishor, the authorised representative of the appellant - Bank and the two respondents. The Consent Terms have also been signed by the Advocate for the appellant and the respondents, who have identified the signatures. 2.
Mr. Kunal Kishor, Mrs. Anu Toshniwal and Mr. Mahesh Kumar Toshniwal confirm that they have signed these terms after 23rd December 2022
201-SA-44-2022 & CA-59-2022.DOC understanding their full scope and import. They further confirm that these terms have been signed voluntarily and of their own accord. Mr. Kunal Kishor states that he has obtained necessary sanctions and is duly authorised to sign these terms. 3.
I have perused the Consent Terms and they are not opposed to public policy. Accordingly, there is no difficulty accepting these terms and disposing of this Second Appeal based upon the same.

The undertakings given by both parties in the terms are accepted as undertakings to this Court.

By accepting the Consent Terms, this appeal is disposed of. There shall be decree in terms of these Consent Terms and all parties shall comply with the same.

The Second Appeal is accordingly disposed of in the above terms. Necessary decree to be drawn. The Civil Application also does not survive the disposal of the Second Appeal. No order for costs.
