By consent clause 5 is partly modified to read: "5.
The Appellant hereby agrees and undertakes to bear the costs of electricity, water and other amenities in respect of the suit flat, including all arrears, if any, until the date of confirmation of sale to the highest bidder. "

The Second Appeal is disposed of in terms of the Minutes as modified.

There will be no order as to costs.
6.
In view of the disposal of the Second Appeal, the Civil Application is dismissed as infructuous.
