Shri Rivankar, the learned Public Prosecutor for the respondents, on instructions, states that the respondent no. 2 shall withdraw the complaint filed before the learned Magistrate, as the respondent no. 2 intends to file a complaint afresh, by joining the Company as a party. The learned Public Prosecutor has produced a copy of letter 02.02.2018, received from the respondent no. 2, which is taken on record and marked 'X' for identification.
3. In view of this statement, nothing survives in the petition, which is accordingly disposed of. It is made clear that this Court
WPCR/89/2016 has not expressed any opinion on the maintainability or otherwise of the complaint, if so filed. Rival contentions of the parties are left open.
