This petition is pending since May, 2017 and various orders have been passed. It appears that there have been several other proceedings, including arbitrations that have taken place between the parties.

Mr. S. D. Lotlikar, learned Senior Counsel appearing for the petitioner, on instructions, submitted that the petitioner may be
Santosh 2 wp887-17 permitted to withdraw the petition keeping all contentions open, in view of the subsequent development, namely that the only other bidder has withdrawn from the fray and, therefore, the challenge raised by the petitioner has been rendered academic at the present. 3.
Mr. S.G. Desai, the learned Senior Advocate for the respondent submitted that as far as further course of action to be taken by the respondent-Authority is concerned, it is for the Authority to take such a decision.

Be as that may, in view of the submissions made by Mr. Lotlikar, it is not necessary for us to examine the matter on merits. 5.
