Heard learned Senior Advocate, Shri A. F. Diniz for the applicant and Shri R. G. Ramani, learned Senior Advocate for Respondents No.1 and 2.

2. The appeal is already admitted. Shri Diniz, learned Senior Advocate on instructions submits that the applicant will deposit in this Court the arrears till date within a period of 8 weeks from today and, thereafter, continue to deposit the mesne profit every 6 months in advance.

Further, a statement is made by Shri Diniz, learned Senior Advocate, on instructions of the applicant, that no third party rights or interest in the property or any encumbrance will be created and that the applicant will not induct any third party or part with possession of the property during the pendency of the First Appeal.

4. The application is allowed in terms of prayer clause (b) subject to the above.
