1. Heard Mr. Walwaikar, learned Counsel for the applicants.

2. This is an application for bringing on record the legal heirs of the sole respondent who expired in the year 2021.

3. The legal heirs of the sole respondent are duly served, however, none appeared.

4. Mr. Walwaikar submits that in the meantime even the appellant expired and his legal heirs are already brought on record. The applicants were unaware about the death of the respondent and the 2nd January, 2024

MCA 399 of 2023 pendency of the proceedings.

5. For the reasons disclosed in the application for condonation of delay, which are considered to be sufficient, the delay stands condoned. The abatement stands set aside and the legal heirs of the respondent are permitted to be brought on record. Amendment to be carried out within one week.
