The petition is allowed. The impugned order is hereby set aside. The application (Exhibit 9) is allowed subject to costs of Rs.15,000/- (Rupees fifteen thousand only) payable to the respondent, within three weeks from today. The trial court shall take the written statement dated 9/7/2018 along with the list of documents annexed to the written statement on record subject to the payment /deposit of costs as aforesaid. The payment/deposit of the costs is condition precedent for setting aside the impugned order. Rule is made absolute in the aforesaid terms.
