During the course of the hearing of the above Appeal, Mr. Celina Barbosa, the daughter in law of the Appellant, who is present in Court, placed on record a copy of the death certificate, inter alia, disclosing that the sole Appellant expired on 16.09.2016. As no legal representatives have been brought on record during the time prescribed, the Appeal stands automatically abated .

2. Hence, the Appeal is dismissed as abated.

3. Needless to say, that the legal representatives of the deceased-Appellant, if so advised, are at liberty to file an appropriate application to set aside the abatement in accordance with law.
