The learned counsel on instructions seeks permission to withdraw the writ petition as the petitioner intends to take recourse to the remedy available under section 293(2) of the Goa Municipalities Act, 1968. The petition is dismissed as withdrawn with liberty as prayed. It is made clear that this court has not expressed any opinion on the merits of the rival contentions. If the appeal is filed with an application for condonation of delay, the appellate authority shall have due regard to the provisions of section 5 r/w section 14 of the Limitation Act.
