In terms of Section 104 of the Civil Procedure Code r/w Order 43 Rule 1(r), the order impugned in this Writ Petition is appealable.

2. Accordingly, Shri S. Malkarnekar, the learned Counsel for the petitioner seeks leave to withdraw this petition with liberty to institute an appeal against the impugned order.

3. Leave is accordingly granted and this petition is disposed off with liberty to institute an appeal.

4. The Registry is directed to return the certified copy of the impugned order to the petitioner/learned Counsel for the petitioner, as early as possible, so that the petitioner can institute an appeal against the same at the earliest.
