On the issue of establishment/designating family courts, the learned Advocate General has placed before us a communication dated 03.11.2022 addressed to the Registrar of the High Court of Bombay seeking concurrence to designate one of the existing courts 3rd January 2023

10-wp-242-2021.doc as a family court in every taluka and to function on nominated days and time.

Ms Shirodkar, learned counsel appearing for the High Court administration submits that some queries have arisen and the same will be intimated to the Government before any decision is taken on the issue of concurrence. She states that such queries inter alia concern issues of staff and infrastructure.

Presently, matrimonial petitions are taken up by the regular civil Courts functioning in the State of Goa. Atleast, the present petitioner has not made out a case that she has a right to the consideration of her case by a family court only. Accordingly, now that the Government has made the above proposal and such proposal is already forwarded to the High Court administration, we do not think any purpose will be served by keeping this petition pending.

Accordingly, we dispose of this petition. The State Government and the High Court administration to take appropriate decision on this issue.

The petition is disposed of.
