After hearing the matter for sometime, Shri Ryan Menezes, learned Counsel appearing for the petitioner, upon instructions, seeks leave to withdraw the above writ petition with liberty to challenge the impugned order in case any adverse order is passed against the petitioner at the time of final disposal of the application for temporary injunction and/or at the time of disposal of the suit on merits, in accordance with law.

2. Hence, the petition stands dismissed as withdrawn, with liberty as prayed for. Needless to say, all contentions of both the parties, on merits, are left open.
