1. On 03/04/2025, in the backdrop facts, we expected the Public Works Department ('PWD' for short) to offer suggestions to deal with the seepage water in the drain, despite installation of the Sewage Treatment Plant ('STP' for short).
2. Mr. Desai, learned counsel appearing for the petitioner, had made a categorical statement before us that he is not averse to implementing any measures upon the PWD suggesting so.
3. We, therefore, directed the PWD to offer suggestions after inspecting the site in the presence of an Authorised Representative of the petitioner.
4. Unfortunately, today the stand adopted before us, by the PWD is that they do not possess expertise, and this work would be better left to the Goa State Pollution Control Board who has granted consent to operate, as what is involved is a STP. We wonder whether the PWD possess any Engineers, as we find that it was a very basic thing that we had asked the PWD to do i.e. after inspecting the site, suggest the measures for tracing the cause of seepage of water from the retaining wall surrounding the project. In any case, since it has now raised its hands and informed us that it cannot do so, we request the Goa State Pollution Control Board, which is represented by learned counsel, Mr.
Salkar, to carry out necessary inspection and suggest the measures, which Mr. Desai has categorically stated that it will be implemented forthwith.
5. In the wake of the aforesaid, since nothing survives for the cause in the petition to be entertained, we dispose of the matter. NIVEDITA P. MEHTA, J.
