2. This is an application to appoint an Arbitrator as the earlier Arbitrator Justice G. D. Kamat (Retired Chief Justice) appointed by this Court has expired. It is pointed out by the learned counsel appearing for the applicant that substantial evidence has already been recorded and the matter was ripe for final disposal. The respondent though served has failed to remain present. Hence, I pass the following :

MCA/468/2016 O R D E R (i) Justice N. A. Britto, former Judge of this Court is appointed as a sole Arbitrator to adjudicate the dispute between the parties.

(ii) The learned Arbitrator shall proceed to consider the evidence stated to be recorded by the earlier Arbitrator after hearing the parties in accordance with law.

(iii) All contentions of the parties are left open. (iv) The application stands disposed of accordingly. F. M. REIS, J.
