DAMIAO ELIREAN CAEIRO ... APPLICANT
Versus
MARIA BRAZILIO CAEIRO, LEGAL REP. OF PARTY NO.1 AND 4 ORS.
... RESPONDENTS Mr Shailesh Redkar, Advocate for the Applicant.
CORAM:
M. S. SONAK, J.
DATED:
P.C.:
1.
Mr Redkar appears for the appellant/applicant in all these matters.
2.
The appeals are already admitted and the matter was today posted for considering the application for interim relief. 3.
Mr Redkar, learned counsel appointed to appear on behalf of the appellant/applicant under the Legal Aid Scheme submits that he has checked the records before the District Court and it transpires that the respondents have already withdrawn the deposited amount in terms of the impugned awards made under Section 30 of the Land Acquisition Act, 1894. 4.
Accordingly, these civil applications have been rendered infructuous. However, it is clarified that the lifting of such amounts by the respondents will abide by the final orders in these appeals. If the appeals are ultimately allowed, the respondents
who have lifted the amounts under the impugned awards will have to bring back these amounts with interest as shall be determined at the final hearing stage.
5.
With the above clarification all these civil applications are disposed of.
