Heard Mr Shivan Desai, learned Counsel appearing for the Petitioner and Mr. Faldessai, learned Government Advocate appearing for the Respondents.

The Petitioner has sought to set aside the communication dated 12 April 2018. By this communication, Goa Coastal Zone Management Authority has informed the Petitioner that his application cannot be considered in view of the order passed by the National Green Tribunal on 22 November 2017. 3.

We have taken a view in Writ Petition No.368 of 2018 that in such circumstances, the Applicant has a remedy to approach the National Green Tribunal. Learned Counsel for the Petitioner sought to distinguish the said decision on the ground that the facts and circumstances are different. However, the stand of the

Andreza wp635-18dt25-06-18 Goa Coastal Zone Management Authority in Writ Petition No.368 of 2018 and in the present Petition remains common, that in view of the order dated 22 November 2017, the application cannot be processed.

In these circumstances, learned Counsel for the Petitioner submitted that the Petitioner will take necessary steps as per law and will consider approaching the National Green Tribunal. 5.

Keeping all remedies of the Petitioner open in that regard, Writ Petition is disposed of.
