Heard Mr Surendra Samant who appears in person. He points out that the petition instituted by him was dismissed for non-prosecution i.e. non-clearance of office objections, i.e. deletion of respondent no.1 in the main petition. 2.

Mr Samant explains that he wanted some directions to be issued to the District Court and therefore the District Court was made a party. Upon explaining to him that if a case is made out, directions can always be issued to the Court to take up matters, 11th August 2023

13-MCA-937-2019.DOC even without the District Court being impleaded as a party, Mr Samant agrees to drop the District Court as respondent no.1. 3.

Accordingly, District Court-2, Panaji at Mapusa, Goa is dropped as respondent no.1 from the array of parties in the petition, after restoring the Writ Petition.

Te Writ Petition filed by the petitioner is accordingly restored. Leave is granted to stop respondent no.1. Te Registry to carry out necessary amendment in the cause title. 5.

Misc. Civil Application No.937/2019 is allowed and disposed of.
