The learned Counsel for the Respondent No. 1-Municipal Council, on instructions, states that the entire demolition, which was proposed, has been carried out and the Municipal Council does not propose to carry out further demolition.

2. In view of this, the learned Counsel for the petitioner, on instructions from the petitioner, who is present before the Court, seeks permission to withdraw the petition with liberty to take appropriate remedy, if any, available in law.

3. The petition is disposed of as withdrawn with liberty as prayed. It is made clear that this Court has not expressed any opinion on competency, maintainability or merits of such remedy, if any.
