On instructions, Mr. Rodrigues, learned Counsel for the Petitioner seeks liberty to withdraw this Writ Petition with liberty to make an application for appropriate amendment in the pending suit filed by the Petitioner.

2. The Writ Petition is dismissed as withdrawn with liberty as prayed. It is made clear that all contentions regarding the maintainability of such application for amendment as well as merits are kept open.

3. If any such application is made, the trial Court shall dispose of the said application on its own merits and in accordance with law, after hearing the objections of the defendants, if any. No order as to costs.
