Heard Mr P. Talaulikar, learned counsel for the appellant. None present for the respondents.
2. Mr Talaulikar placed a notarised copy of the agreement dated 13.5.2024 which is taken on record and marked X for identification. Mr Talaulikar, submits that by way of this agreement executed between the parties, the dispute between them stands settled. He submits that in view of clause no.6 of the said agreement, appellant prays for withdrawal of the present appeal unconditionally.
3. Clause no. 6 reads thus:- "That the Second Party have preferred a second appeal before the honourable High Court and in view of the present agreement Second Party shall withdraw the second appeal before honourable High Court unconditionally."

4. Mr Talaulikar, submits that party no.2 in the said agreement by name Rohan is power of attorney holder of the appellant. He submits that the dispute is now settled and therefore the appellant be permitted to withdraw the appeal.
5. In view of the agreement dated 13.5.2024 and more specifically clause (6), the appellant is permitted to withdraw the Second Appeal. Accordingly, the Second Appeal stands withdrawn. Proceeding stands closed.
