1. The Registry to waive the office objections and register the matter.

2. The challenge in this petition is primarily to an order of the Goa Coastal Zone Management Authority (GCZMA for short) granting the approval for a project which, according to the petitioner, falls within the Non Development Zone (NDZ for short) and more specifically in the Coastal Regulation Zone-I.

3. The petitioner has also raised a challenge to the approval on the contention that the project is due to come up within a Turtle Nesting Site.

4. Considering that the primary challenge is to an order i.e. appealable under Section 18 of the National Green Tribunal (NGT) Act, 2010, where an appeal would lie before the National Green Tribunal (NGT for short), the petition would not be maintainable before this Court.

5. Learned Advocate for the petitioner, upon instructions, submits that he would withdraw the present petition with leave to file appropriate appeal before the NGT.

6. Writ petition stands dismissed as withdrawn with leave as prayed for.
