IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 666 OF 2013 SMT. CHANDRAKALA S. REDKAR ... Petitioner

Versus

STATE OF GOA REP. BY ITS CHIEF SECRETARY AND 2 ORS., ... Respondents Mr. J. Abreu Lobo, Advocate for the petitioner. Ms. S. Mordekar, Addl. Government Advocate for the respondents. Coram:- F. M. REIS & K. L. WADANE, JJ.

Date:- 11th February, 2015 P.C.

Heard Mr. J. Lobo, learned counsel appearing for the petitioner and Ms. S. Mordekar, learned Addl. Government Advocate appearing for the respondents.

2. The grievance raised by the petitioner is essentially that though an application and process for allotting a plot in favour of the petitioner by the Communidade of Nashinola was initiated way back in the year 1997, the exercise is not yet completed as the matter is pending for approval before the State Government.

3. During the course of the proceeding of the above petition, there were orders passed by this Court in view of a grievance raised by the petitioner that though the original plot allotted was admeasuring 400 square metres, only an area of 315 square metres was available at the site. The learned counsel appearing for the petitioner upon instructions states that the petitioner is prepared to

WP/666/2013 take such area of 315 square metres in lieu of 400 square metres allotted to the petitioner. Another grievance raised by the petitioner was that though only an area of 315 square metres was available for conversion, the Revenue Authorities were claiming conversion charges for an area of 400 square metres.

4. The petitioner was given liberty by the orders passed by this Court dated 22.09.2014 and 17.11.2014 to make a representation with that regard to the concerned authorities. Mr. Lobo, learned counsel appearing for the petitioner upon instructions states that such representation has already been submitted by the petitioner to the respondent nos.1 and 3 which have not yet been disposed of. Considering the nature of the grievances raised herein above, we find it appropriate to dispose of the above writ petition by directing the respondent nos. 1 and 3 to dispose of the representations submitted by the petitioner in connection with the subject plot as expeditiously as possible and in any event within 12 weeks from today in the light of the observations made herein above in accordance with law. The Writ Petition stands disposed of accordingly. Liberty to the parties to apply.
