Mr. Ramani, learned Counsel for the applicant seeks leave to withdraw the application with liberty to approach Executing Court in the light of the Judgment of the Apex Court in the case of Oriental Insurance Co. Ltd Vs. Nanjappan and others, (2004) 13 SCC 224.

2. Leave is granted with liberty as prayed for. Amount deposited by the respondent no.1 in this appeal shall be transferred alongwith accrued interest in the Executing Court i.e Motor Accident Claims Tribunal, Panaji in Claim Petition No.175/1995.
