After this petition was heard for sometime, learned Counsel for the petitioners seeks leave to withdraw the petition with liberty to agitate the cause in the amendment application as filed under order VI Rule 17 of the Civil Procedure Code, in a fresh suit which may be instituted by the petitioners-plaintiffs.

2. Allowed to be withdrawn with liberty as prayed for. Disposed of.

3. If any fresh suit is filed, all contentions of the parties on such suit are expressly kept open.
