Heard learned counsel for the applicants.

2. This is an application for condonation of a delay of 64 days in filing the application to bring on record the legal representatives of the deceased appellant no.2 on record.

3. The application is opposed by the learned counsel for the respondents.

4. Learned counsel for the applicants has relied on the decision of the Hon'ble Supreme Court in the case of N. Balakrishnan V/s. M. 13th September, 2024

MCA 291 of 2024 Krishnamurthy - (1998) 7 SCC 123 in support of her contentions.

5. After going through the reasons mentioned in the application and on considering the rival contentions of the parties, I am satisfied that the application can be allowed in terms of prayer clauses (a) and (b). The application is accordingly allowed. The delay of 64 days in filing the application to bring legal representatives of the deceased appellant no.2 on record is condoned. The applicants are allowed to bring the legal representatives of the deceased appellant no.2 on record. Amendment to be carried out within two weeks.
