The applicant is challenging the judgment and order dated 15.06.2023 and 21.06.2023 passed by the Sessions Judge North Goa convicting the applicant for offences under Section 7, 13(1)(d) r/w 13(2) of the Prevention of Corruption Act, 1988. The applicant was sentenced to undergo simple imprisonment for a period of six months and a fine of Rs.10,000/- for offences punishable under Section 7 of the said Act and to undergo a sentence of simple imprisonment for a period of 1 year and to pay a fine of Rs.25,000/- for offences punishable under Section 13 of the Act.

2. The applicant is stated to be 68 years of age and has undergone heart surgery and requires regular medical attention. The applicant was on bail during the trial and there is nothing on record to indicate that the applicant has misused his liberty.

3. In this view of the matter, the conviction and sentence imposed on the applicant vide the aforesaid judgment by the learned trial Court is suspended. The applicant is released on the same bail conditions as in the trial Court but upon furnishing a fresh PR bond.

4. Learned counsel for the applicant submitted that the fine amount has already been paid.

5. Application is disposed of.
