Date:- 6th June 2019 ORAL ORDER : (Per NUTAN D. SARDESSAI, J.) Heard Mr. G. Teles, learned Counsel for the petitioner and learned Additional Public Prosecutor for the respondents on behalf of the State.

2. The applicant seeks his release on furlough on the premise having last availed furlough in March, 2018.

3. Mr. P. Faldessai, learned Additional Public Prosecutor submits on instructions that the furlough application was not considered in view of the fact that he had earlier been granted

WPCR/128/2019 furlough and moreover as the Model Code of Conduct was in force. In short, he concedes that leniency can be shown in the matter and the petitioner ordered to be enlarged on furlough.

4. Considering the fair concession by the learned Additional Public Prosecutor for the respondents, the application for furlough is granted. The respondents are directed to release the petitioner on furlough on regular conditions to be imposed against the petitioner.
