1.

This is an application filed under section 11 of the Arbitration and Conciliation Act, 1996 (for short, "the Act") whereby the applicant has prayed for appointment of an Arbitral Tribunal to adjudicate the disputes and differences between the parties, which have arisen under a agreement dated 1 December 2010. There is an arbitration agreement between the parties, which is contained in Clause 30.1 of the agreement. There is no dispute on the existence of an Arbitration agreement. As the respondent did not agree for

appointment of an Arbitral Tribunal, the applicant set into motion the procedure as contemplated under Section 11 of the Act. Accordingly, the present application was filed for appointment of an Arbitral Tribunal.

2.

Learned counsel for the respondent has fairly stated that his client is agreeable for the disputes being referred for adjudication by appointing a sole arbitrator.
