2. Though Respondent No. 1 is duly served, none appeared.

3. This is an Application for grant of leave to Appeal.

4. The learned Counsel for the Applicant submits that there are sufficient grounds for grant of leave as the proceedings before the learned Magistrate were dismissed in default on the only occasion when the Complainant was absent.

5. Considering the material placed on record, there are sufficient 14th February, 2024

CRMA 53 of 2022 grounds to grant leave to file an Appeal. Accordingly, this Application stands allowed thereby granting leave to file an Appeal.
