The learned Advocate General states that the impugned Communication dated 22nd September 2016 issued by the Under Secretary,(Estt.), Department of Law & Judiciary was passed without any lawful authority and was not taken after following due procedure of business and, therefore, the State is withdrawing the said communication. The statement is accepted. 2.

The learned Advocate General further submits that the question as to whether the Petitioners would fall within the recommendation of the Shetye Commission is under consideration of the Government and a decision thereupon will be taken within a period of six weeks.
