his is an application for suspension of sentence imposed upon the applicant on he being convicted for the ofence under Section 20(b)(ii)(B) of the NDPS Act by the Sessions Court by order dated 03.06.2025. he applicant has to undergo sentence of rigorous imprisonment for ive years and pay ine of Rs.25,000/- and in default to undergo further imprisonment of six months.

Mr Kautuk Raikar, learned advocate for the applicant submits that the applicant, during the course of the trial was released on bail by order dated 20.07.2018 of the Sessions Court on conditions imposed therein; hroughout the trial, none of these conditions have been breached. he applicant is taken into custody by the Sessions Court on 03.06.2025. Mr Raikar submits that the applicant had throughout attended the trial and he is willing to abide by the conditions imposed by this Court for suspension of the sentence, pending the hearing of the appeal. 3.

Considering the record, and the submissions made, the sentence imposed on the applicant by the Sessions Court shall stand suspended until the disposal of the appeal on the following conditions:

(a) he applicant shall be released by the Superintendent, Central Jail, Colvale on him executing a P. R. Bond of Rs.25,000/-. On being released the Superintendent, Central Jail shall forward a copy of the P.R. Bond to the Registry of this Court which has to be placed in the ile of the appeal. (b) In addition, the applicant shall secure his release with one surety in the amount of Rs.25,000/-, which has been already secured by furnishing a bond to that efect by the surety before the Sessions Court. he said surety/bond shall be kept alive during the course of the appeal. (c) he applicant shall place on record a copy of his Aadhar Card and any other alternate proof of identity with

one copy to be handed over to the learned Additional Public Prosecutor to place in possession of the investigating oicer. In addition, the applicant shall provide proof of his local address and his phone number, which shall be kept on throughout to enable the investigating oicer to trace him if required. he proof of local address may be furnished within a week from his release, considering the applicant is required to take a place on rent.

(d) he applicant shall not leave the State of Goa during the course of the hearing of the appeal without prior permission of this Court; He shall continue to attend the hearings of the appeal as and when called upon by this Court.
