Heard the learned counsel for the Applicant and the learned Public Prosecutor.

The learned Public Prosecutor, on instructions from the Investigating Officer, who is present before the Court states that he has no objection to permit the applicant/accused to travel beyond the territory of Goa to her native place at Indore, Madhya Pradesh for a period of 30 days. This will take care of prayer clause 12 (a). In so far as prayer clause 12(b) is concerned, it would be appropriate if similar applications, if any, are

CRMA/154/2018 considered by the learned Magistrate First Class at Mapusa before whom the applicant is facing trial. In such circumstances, the following order is passed:

ORDER:

(i) The applicant is permitted to travel beyond the territory of Goa to her home at Indore, Madhya Pradesh for a period of 30 days subject to an undertaking to remain present on the next date of hearing and as when the criminal case is listed. (ii) The undertaking shall be filed along with the native address and proof thereof before the learned Magistrate. (iii) Further similar applications, if any filed by the applicant can be entertained by the learned Magistrate in accordance with law.
