For the reasons set out in the Civil Application it is made absolute in terms of prayer clause (b).

The Respondent/Applicant is permitted to withdraw the amount of Rs.1,25,03,731/- along with all interest accrued from the date of deposit and investment. Correspondingly, the Appellant, the Board of Trustees of the Port of Mormugao, is at liberty to withdraw the balance amount of Rs.34,72,702/- similarly with all interests accrued from the date of deposit/investment.

The registry will process this application on production of an authenticated copy of the order. This will be done within four weeks 29th September 2017

For each of the parties the refund of the principal amount and interest will be by RTGS transfer to that party's bank accounts, the details of which will be furnished by the parties to the registry (Accounts Section) by 13th October 2017.
