Upon hearing the learned Counsel appearing for the respective parties, it is seen that the only grievance of the petitioner is that he has preferred an appeal before the Chief Secretary of Goa which has not been disposed of.

2. Mr. Rivankar, learned Public Prosecutor appearing for the respondents has produced a copy of the notice dated 30th July, 2015, calling upon the parties to remain present with regard to the said appeal. Mr. Rivankar also makes a statement that such proceedings shall be disposed of within three months from today. The copy of the said notice is taken on record and marked "X" for identification.

3. In view of the said notice, and accepting the said statement

WPCR/85/2015 of Mr. Rivonkar, nothing survives in the above writ petition. The learned Counsel appearing for the petitioner, accordingly, seeks leave to withdraw the writ petition.

4. The petition is, accordingly, dismissed as withdrawn. All contentions of both the parties, on merits, are left open. K. L. WADANE, J.
