The Trial Court convicted the respondent-accused for offence punishable under Section 138 of the Negotiable Instruments Act. However, the Appellate Court reversed the same on the ground of non-compliance of mandatory conditions of service of notice before initiation of the prosecution. Arguable case is made out. Leave granted.
